Bennie v. Lloyd

Before:  P. Love
Appearances: Bennie, for the complainant; D. Fisher, for the respondent
Decision rendered:  December 15, 2004

Procedure - Abandonment of complaint - the complainant filed an unfair labour practice complaint against her bargaining agent's representative under paragraph 23(1)(a) of the Public Service Staff Relations Act, alleging a violation of his duty of fair representation pursuant to subsection 10(2) - she did not attend the hearing on her complaint - the Board then wrote to the complainant on two occasions to enquire as to her intentions regarding the complaint - the Board's staff also sent e-mail messages to the complainant and left messages on her answering machine - because the complainant did not respond to any of the attempts to contact her after the hearing, the Board concluded that she did not wish to pursue her complaint and directed that the proceedings be terminated and the file closed.

Complaint dismissed.
