Suspension during investigation – Termination (disciplinary) – Disappearance of  equipment – Unauthorized use of taxi coupons – Threats uttered to colleagues – Firearms

The employer suspended the grievor during a disciplinary investigation into the disappearance of equipment, the unauthorized use of taxi coupons and the uttering of threats involving the use of firearms – the grievor had been an elite marksman in the Canadian Armed Forces – as a result of the investigation, the employer dismissed the grievor – he filed a grievance against his suspension and dismissal – the evidence showed that the grievor had gained unauthorized access to the warehouse – the grievor was also unable to justify the use of all of his taxi coupons – the adjudicator found that these breaches tainted the grievor’s integrity but did not, in and of themselves, justify his dismissal – the adjudicator found that the grievor had intimidated his colleagues by uttering threats against them that involved the use of firearms – the evidence showed that the grievor failed to treat his colleagues with respect – the grievor’s suspension during the investigation and his dismissal were justified under the circumstances.
