Complaint under section 190 of the Public Service Labour Relations Act – Duty of fair representation – Refusal to refer grievance to adjudication – Refusal to make a complaint against the employer

The complainant was dissatisfied with the representation that his bargaining agent had provided – after obtaining a lengthy legal opinion and considering the matter, the bargaining agent refused to refer the complainant’s grievance to adjudication and to make a complaint against the employer with the Board – the Board ruled that the bargaining agent had not acted in a discriminatory or arbitrary fashion or in bad faith in representing the complainant’s interests.

Complaint dismissed.
