Complaints – Duty of fair representation – Penalty for filing a complaint – Refusing to designate complainant as union steward – Objection to jurisdiction

The complainant alleged that his bargaining agent local had excluded him from a grievance hearing, had failed to support him in another grievance, had tried to prevent him from attending a union meeting and had refused to select him as union steward because he had filed a previous complaint – the bargaining agent respondent argued that the Board had no jurisdiction to rule on the complaints related to attending union meetings or being selected as union steward as they were internal union matters – as to the duty of fair representation, the bargaining agent submitted that it had fairly represented the complainant in the grievance – the Board found that it had no jurisdiction over the complaints related to internal matters and that the complainant had presented no facts to sustain his allegation that the bargaining agent had not fairly represented him.

Complaints dismissed.
