Complaint under section 190 of the Public Service Labour Relations Act – Resignation – Settlement – 90-day time limit

The complainant filed a complaint against his employer and his bargaining agent more than three years after the events that gave rise to the complaint against the employer – the complainant alleged that the employer had discriminated against him, which led to his resignation – the complainant filed a grievance when the employer refused his retraction of his resignation – he also alleged that his bargaining agent had not represented him properly – the grievance against his employer was settled after mediation with the help of the bargaining agent, two years before the complaint was filed – the Board ruled that the complaint was untimely.

Complaint dismissed.
