
Complaint under section 190 of the Public Service Labour Relations Act – Duty of fair representation – Resignation – Settlement
The complainant alleged that his bargaining agent had not fulfilled its duty of fair representation in various grievances against the employer – the complainant had resigned but was of the opinion that he had been constructively dismissed from the public service – the bargaining agent withdrew representation services after negotiating a settlement with the employer that the complainant refused to accept – the Board found that the bargaining agent had not failed in its duty to represent the complainant diligently.
Complaint dismissed.
