
The grievor extended a number of times the delay for a hearing of his grievance concerning his suspension without pay in the wake of a criminal charge – the grievor referred his grievance to adjudication well after the deadline for the employer to respond to the grievance at the final‑level of the grievance process – the Deputy Head applied for an extension of time to reply to a grievance at the final‑level – the Deputy Head also objected to the premature referral of the grievance to adjudication – the Chairperson found that the referral was not premature given the length of time that the grievor had waited for a response to his grievance – the Chairperson also found that considerations that would apply to a grievor requesting an extension of time did not apply to the employer – since there was no restriction on the Deputy Head replying to the grievance at any time before the hearing, there was no need to extend the time limit.
