Grievance – Religious discrimination – Violation of the collective agreement – Breach of the Canadian Human Rights Act (CHRA)
The grievor alleged that the employer had discriminated against her by allowing a poisoned work atmosphere to develop in reaction to her religious beliefs – accommodation was first provided to the grievor by allowing her time off to attend to her religious obligations – the accommodation became more restricted, and the employer received hate correspondence referring directly to the grievor and her religion – the employer conducted an investigation, with no results – ultimately, the grievor’s secondment was ended sooner than scheduled – the adjudicator found that the employer had failed to prevent harassment and discrimination in the workplace and ordered the parties to settle on remedies as provided by the CHRA.
