Before: Michel Paquette
Decision Rendered: June 15, 2010
Original Language: English
Grievance – Disability – Insubordination – Medical defence – Appropriate disciplinary penalty

The grievor was terminated following a series of confrontations with the employer – the bargaining agent argued that the grievor’s actions were due to a medical condition – the adjudicator found that the grievor failed to establish a medical defence – the grievor’s behaviour justified the employer’s decision to terminate.

Grievance dismissed.
