
Complaint under section 133 of the Canada Labour Code – Objection with respect to 90-day time limit – Request for extension of time
The complainant filed a complaint under the Canada Labour Code – the employer raised a preliminary objection that the complaint was untimely – the complainant maintained that the amendments to the Code gave the Board the discretion to extend the time – the Board held that the relevant provisions did not grant it that discretion and that therefore it did not have jurisdiction over the complaint.
Complaint dismissed.
