Subject terms:

Complaint under section 133 of the Canada Labour Code (“the Code”), alleging reprisal action in violation of section 147 – Jurisdiction

The complainant filed a complaint based on section 133 of the Code, alleging a contravention of section 147 – the respondent objected that the essential components of a section 133 complaint were absent and that the complaint was untimely – the complainant completed his complaint by providing particulars – the Board found that the complaint form did not specifically state any alleged actions contrary to section 147 of the Code – the Board further found that the alleged actions provided in the particulars were vague and that they could not arguably have violated section 147 of the Code – the Board found that it did not have jurisdiction to hear the complaint.

Objection allowed.

Complaint dismissed.
