Thompson and Ramier and Treasury Board (Solicitor General Canada - Correctional Service)
Before: I. Deans
Appearances: D. Dagger, for the Grievors; L. Fudge-Lunetta, for the Employer
Decision rendered: August 20, 1996
Suspension (45 and 60 days) - Misconduct - Correctional officers left posts unattended and broke into filing cabinet to view pornographic material - the grievors, correctional officers, left their posts unattended and broke into a filing cabinet of a sexual behaviour clinic of a correctional facility to view pornographic material of an explicit kind, including child pornography - one grievor, a CO-I, was suspended without pay for a period of 45 days while the other, an acting CO-II, was suspended without pay for a period of 60 days - the grievors admitted their actions but argued that the discipline was extreme in view of their clean disciplinary records - the adjudicator found that the discipline imposed was justified in the circumstances.
Grievances denied.
