Post and Treasury Board (Transport Canada)
Before: Y. Tarte
Appearances: Decided without an oral hearing
Decision rendered: May 15, 1998
Termination (disciplinary) - Grievance procedure - Abandonment of grievance - the grievor grieved the termination of his employment - three postponements were requested by the parties, who were in the process of negotiating a settlement - the grievor's representative eventually informed the Board that a settlement had been reached, but that the grievor had not yet authorized the withdrawal of his grievances from adjudication - the grievor's representative later informed the Board that the bargaining agent was no longer representing the grievor and provided the Board with the grievor's address - the Board wrote to the grievor on three occasions with no success: the first time the letter was returned with the mention "Unknown at address"; the second time, the letter was returned with the mention "Unclaimed"; the third time, the letter was returned with the mention "The customer saw the item and then refused to accept. He wouldn't sign to say he refused it. Therefore, it was returned unclaimed." - the adjudicator was satisfied that the grievor did not wish to proceed with his grievances.
Grievances denied.
