Before: B. Turner
Appearances: Roberts, for the Grievor; R. Snyder, for the Employer
Decision rendered: July 12, 1996
Suspension (3 days) - Altercation with fellow employee - Credibility - grievor who was a shop safety representative went to the office of the acting chargehand to make a telephone call with respect to what he considered to be a safety matter - an altercation took place as a result of which the acting chargehand received a five-day suspension and the grievor received a three-day suspension - the acting chargehand did not grieve his suspension - grievor and acting chargehand presented different versions of events - after considering all evidence adjudicator accepted grievor's view of events as the most credible - adjudicator found grievor misconducted himself by not having left the office when ordered to do so - adjudicator concluded that discipline imposed was too severe and reduced the three-day suspension to a written reprimand.
Grievance allowed in part.
