Hanf and Treasury Board (Citizenship and Immigration Canada)

Before: B. Turner
Appearances: D. Conn, for the Grievor; A. Oberst, for the Employer
Decision rendered: February 16, 1998

Subject terms:

Suspension (3 days) - Forgery - the grievor, an Expulsions Officer, prepared a false Yellow Fever Vaccination Certificate to facilitate a deportation and gave it to the two Escort Officers charged with escorting the deportee to destination - the Escort Officers were told that the Certificate was a false document and they did not use it during the escort trip - the employer suspended the grievor without pay for five days - this suspension without pay was later reduced to three days by the employer and the disciplinary reference was removed from the grievor's personnel file - the employer argued that the grievor's poor judgement required discipline, since falsification of a health certificate could not be condoned - the grievor submitted that the two Escort Officers received no disciplinary measures and that the employer had suspended her to show that it took action - the adjudicator found that the role of the two Escort Officers was not an issue he had to address - the adjudicator decided that discipline was warranted and that the three-day suspension without pay was appropriate in the circumstances.

Grievance denied.
