Vant v. Canada Customs and Revenue Agency

Before: Y. Tarte
Appearances: Decided without an oral hearing
Decision rendered: January 10, 2003

Subject terms:

Abandonment of grievance – Failure of grievor to respond to Board's correspondence – Proceedings terminated – the grievances concerned an indefinite suspension and a discharge and had been held in abeyance pending resolution of criminal matters – on July 24, 2002, the Public Service Alliance of Canada informed the Board that the criminal matters had been concluded and that despite numerous efforts, the bargaining agent had been unable to contact the grievor – the bargaining agent informed the Board that it was withdrawing its support of the grievances – the Board wrote to the grievor on three separate occasions, between July and November, to inform him that the bargaining agent was no longer representing him in these matters and to request that he inform the Board whether he wished to proceed to mediation or hearing – because the grievor did not respond to any of the letters from the Board, the chairperson concluded that the grievor did not wish to pursue his grievances and he directed that the proceedings be terminated and the files closed.

Grievance dismissed.
